"Blue Sky" Securities Regulation in Nebraska

The Nebraska Department of Banking and Finance administers the Securities Act and regulates the securities industry on behalf of the state. In the above matter, Claimant alleged that Respondent was liable for damages based on numerous causes of action, including violation of the Securities Act of Nebraska, misrepresentation, breach of fiduciary duty, and breach of FINRA's Conduct Rules. Specifically, Claimant argued that Respondent purchased auction rate securities and then neglected to inform him about the nature of the securities, the auction process, and the effect a failed auction could have on the securities.
